Suffolk General District Court James Moore on Monday tossed out charges against a Franklin man charged with felony possession of counterfeit merchandise.

Moore dismissed the case against 44-year-old Dwayne S. Goodman, who was arrested in May after a Suffolk detective noticed him selling bootleg merchandise from his car in the 800 block of West Washington Street.

Moore indicated that prosecutors did not have sufficient evidence to proceed with the case, said Assistant Commonwealth's Attorney Vaughan Breedlove, who was prosecuting the case.

The case will be reviewed by a grand jury for possible indictment, he added.

When he was arrested, Goodman was attempting to sell more than 200 DVDs and assorted clothing from his vehicle, police said. Police later confiscated more than 600 bootleg items, including fake athletic gear, jerseys and Timberland shoes, from Goodman's residence in the 100 block of Broad Street, Franklin.
