54 indicted by grand jury

A man police say was driving under the influence of alcohol with three children in the car was among 54 defendants indicted by the grand jury on 155 charges last week.

Herbert Bates III, 37, is charged with his third offense within the last 10 years of driving while intoxicated, according to the grand jury report, as well as three counts of child neglect or abuse with reckless disregard for their life.

According to a warrant on file with Suffolk Circuit Court, officers attempted to stop Bates’ vehicle about 11:25 p.m. July 12 in the 4000 block of Bridge Road. His music was too loud, an officer wrote in the warrant.

The vehicle continued until it stopped at the Belleville Harbour Apartments in the 6000 block of Belleharbour Circle. The vehicle then tried to reverse back towards the officers as they approached the vehicle, the officer wrote.

Bates smelled of alcohol and had slurred speech, the officer wrote. An open beer was in the center console.

Bates told the officers he’d had a shot of liquor at 10:30 p.m., two beers 15 minutes prior to driving, and one sip of the beer in the console.

Bates performed “very poorly” on field sobriety tests and blew a .235 on a preliminary breath test. His blood alcohol content was .23 at 12:49 a.m.

Three children, ages 6, 8 and 10, were in the vehicle. “None of them were in any type of child seat, nor were they wearing seatbelts,” the court documents noted.

Another defendant indicted last week is charged with assaulting the mother of his child and child abuse or neglect.

On Aug. 13, Latay Devon Darden, 31, arrived to return his daughter to her mother, according to a warrant on file in Suffolk Circuit Court.

He “tossed the car seat with their daughter in it on the ground,” the warrant states. When the mother attempted to get her daughter out of the car seat, the warrant states. Darden pushed her against a wall, grabbed her by the throat with one hand and pushed her face into the wall with the other hand.

He left when she was able to get a hand on her phone and call 911, the warrant states.
