Board revokes licenses of area contractors

The Virginia Board for Contractors issued 25 license revocations at its most recent meeting this month. The following is a summary of the Board’s actions.

Fines are deposited directly into the state Literary Fund, which is used solely for public education purposes such as school construction, renovation, and teacher retirement funding.

nEric R. Crafton trading as Crafton’s Home Improvements, Franklin, File Number 2003-02912

Complainant – Shelvy Hunt (Franklin)

Violations – Crafton failed to include all required provisions in the written contract; practiced outside his class of license; failed to complete work for which he contracted; retained funds related to uncompleted contract items; and failed to respond to an investigator.

Board action – Revocation of License No. 2705063418 and a $9,000 fine.

nDominion Builders II Inc., Norfolk, File Number 2004-00020

Complainant – Ella Hayes (Chesapeake)

Violations – Dominion failed to operate in the name in which the license was issued; failed to include all required provisions in the written contract; failed to obtain the required building permit; retained funds related to uncompleted contract items; and failed to notify the Board of a change of address.

Board action – Revocation of License No. 2705070015 and a $1,450 fine.

Complainant – Patty Frashure (Chesapeake)

Violations – Dominion failed to operate in the name in which the license was issued; failed to execute a fully written contract and to include all required provisions in the contract; failed to honor the terms and conditions of a warranty; failed to obtain the required building permit; and failed to notify the Board of a change of address.

Board action – Revocation of License No. 2705070015 and a $2,250 fine.

Complainant – Debra and Daniel Schroeder (Virginia Beach)

Violations – Dominion failed to operate in the name in which the license was issued; failed to include all required provisions in the written contract; failed to obtain the required building permit; failed to complete work for which it contracted; retained funds related to uncompleted contract items; failed to honor the terms and conditions of a warranty; and failed to respond to an investigator.

Board action – Revocation of License No. 2705070015 and a $9,050 fine.

Complainant – Kathryn West (Norfolk)

Violations – Dominion failed to operate in the name in which the license was issued; failed to include all required provisions in the written contract; failed to complete work for which it contracted; retained funds related to uncompleted contract items; and failed to respond to an investigator.

Gayles Enterprises LLC, trading as A-One Home Improvements & Repairs, Norfolk.

Complainant – Leah Gonzales (Virginia Beach)

Violations – Gayles failed to include all required provisions in the written contract; practiced outside its classification and class of license; failed to obtain written change orders for modifications to the contract; failed to obtain the required building permits; engaged in negligence and/or incompetence by performing work containing deficiencies; and retained funds related to uncompleted contract items.

Board action – Revocation of License No. 2705074946 and a $12,000 fine.

R&R Construction & Development Inc., Chesapeake

Complainant – Sharon and Willie Gray, Jr. (Portsmouth)

Violations – R & R failed to operate in the name in which the license was issued; failed to include all required provisions in the written contract; contracted with an unlicensed subcontractor in the delivery of services; failed to obtain written change orders for modifications to the contract; engaged in misconduct by failing to meet industry and code standards; and failed to complete work for which it contracted.

COMPLAINANT – Dr. Ronald L.G. Bonheur (Norfolk, VA)

VIOLATIONS – Weeks failed to include all required provisions in the written contract; failed to comply with the terms of the contract; failed to complete work for which he contracted; engaged in improper or dishonest conduct in the practice of contracting; failed to respond to an investigator; and failed to satisfy a court judgment.

BOARD ACTION – Revocation of License No. 2701034827 and a $3,500 fine.

COMPLAINANT – Larry Hooper (Newport News, VA)

VIOLATIONS – Bailey failed to execute a fully written contract and failed to include all required provisions in the contract; failed to complete work for which he contracted; failed to obtain a final inspection; engaged in improper or dishonest conduct in the practice of contracting; failed to respond to an investigator; and failed to satisfy a court judgment.

COMPLAINANT – Harold Gaskill, Virginia Beach Permits and Inspections Division

VIOLATIONS – Huddle engaged in misconduct by not following the building code and failed to correct building code violations.

COMPLAINANT – Sally and Richard Lippert (Virginia Beach, VA)

VIOLATIONS – Wieland failed to include all required provisions in the written contract; practiced outside his specialty and class of license; failed to obtain written change orders for modifications to the contract; failed to obtain required permits; failed to complete work for which he contracted; and retained funds related to uncompleted contract items.

BOARD ACTION – Revocation of License No. 2705066001 and a $15,000 fine.

About DPOR and the Board for Contractors:

The Virginia Department of Professional and Occupational Regulation (DPOR) administers and enforces laws regulating 31 commercial occupations and certain professions. The agency licenses or certifies more than 265,000 individuals and businesses ranging from architects and contractors to cosmetologists and professional wrestlers.

DPOR investigates reports of regulatory violations by licensees; pursues complaints of criminal activity by unlicensed practitioners; responds to business-related consumer inquiries and requests for license checks; administers recovery funds for consumers harmed in contractor or real estate transactions; and conducts mediation services and public awareness campaigns.

The Board for Contractors licenses over 90,000 Virginia businesses and individuals. The Board is composed of a Class A general contractor; a sub-contractor; contractors specializing in utilities, commercial and industrial buildings, single-family residences, and home improvements; a building supplier; a local building official; licensed tradesmen in plumbing, electrical, and heating, ventilation and air conditioning (HVAC); and two citizen members.

The Board administers the Virginia Contractor Transaction Recovery Fund, which provides monetary relief to consumers who incur losses through the improper and dishonest conduct of a licensed contractor. The fund is supported entirely by assessments paid by licensed contractors, not by any tax revenues.
