School board attorney assault case continued

Suffolk School Board Attorney Wendell M. Waller will answer to misdemeanor assault and battery charges in court later this month.
Waller and Winford K. Rice, 44, of Skeetertown Road, who filed warrants against one another after an April 11 altercation at the attorney’s Ashford Drive home, initially were scheduled to appear in Suffolk General District Court Monday.
The case was continued until May 23, according to a spokeswoman in the clerk’s office.
According to the criminal complaint, Rice pressed charges against Waller, 47, pastor of Christian Homes Baptist Church in Windsor, on April 11 after a verbal disagreement. Then, according to Rice’s criminal complaint, the two men ‘&uot;grabbed each other,… began wrestling…and both went to the ground.&uot;
Waller, who turned himself into police on April 12, was released on his own recognizance.
That same day, Waller secured warrants charging Rice with assault and battery and destruction of property. In that warrant, Waller claimed that Rice &uot;intentionally destroyed and defaced…a kitchen wall…with value less than $1,000.&uot;
Rice was arrested on April 16.
