Assault and battery charges filed against local pastor and Suffolk School Board Attorney Wendell M. Waller were dismissed last week.

Waller and Winford K. Rice, 44, filed warrants against each other after an April 11 altercation, which stemmed from Rice’s inquiry surrounding the attorney’s contact with his wife.

According to Rice’s criminal complaint, the two men &uot;grabbed each other… began wrestling… and both went to the ground.&uot;

Waller, who also serves as a substitute judge, turned himself in to police on April 12 and was released on his own recognizance. A day later he pressed charges against Rice, accusing him of assault and battery and destruction of property.
